TERMS OF USE

Article 1 — Parties and Scope

These Terms of Use ("Terms") apply to any natural or legal person ("User") who visits or uses the prysmon.com website and the GoProp Platform ("Platform") operated by Prysmon Yazılım Hizmetleri ("Prysmon").

For persons using the Platform in the capacity of an advisor on behalf of a real estate office, the Advisor Terms of Use and the Confidentiality and Non-Compete Agreement shall apply in addition to these Terms. In the event of a conflict between these Terms and the Platform Service Agreement to which the office is a party, the order of precedence set out in Article 24 of the Platform Service Agreement shall prevail.

Article 2 — Account and Access

• The User is responsible for maintaining the confidentiality of their own access credentials (password, two-factor authentication code).

• If unauthorized use of the account is suspected, this must be reported immediately to Prysmon or to the office administrator.

• The User is responsible for the accuracy and legal compliance of any information they share or enter on the Platform.

Article 3 — Acceptable Use

The User agrees to use the Platform only for lawful purposes; not to share content that infringes the rights of others, is misleading, malicious, or unlawful; not to engage in attempts that threaten the security of the system; and not to scan the Platform with automated tools (bots, scrapers, etc.).

More detailed rules applicable to real estate offices and advisors are set out in Article 8 of the Platform Service Agreement and in the Advisor Terms of Use.

Article 4 — Intellectual Property

The Platform, its source code, design, algorithms, database structure, brand name, logo, and all content are the exclusive intellectual property of Prysmon, protected under Law No. 5846 on Intellectual and Artistic Works ("FSEK") and related legislation. The right granted to the User is solely a personal, non-transferable, and non-exclusive right of use appropriate to the purpose of the Platform; this right does not include the rights of copying, modifying, distributing, reverse engineering, or creating derivative works.

Article 5 — Protection of Personal Data

For detailed information regarding the personal data processed through the Platform, please refer to the Prysmon Privacy Notice (KVKK Aydınlatma Metni); for information regarding the use of cookies, please refer to the Prysmon Cookie Policy.

Article 6 — Limitation of Liability

The Platform is provided on an "as is" basis. Prysmon does not guarantee that the Platform will operate uninterrupted or error-free. Liability limitations applicable to real estate offices are separately set out in Article 11 of the Platform Service Agreement.

Article 7 — Amendments

Prysmon may update these Terms by providing reasonable prior notice. The current version is published at prysmon.com/en/terms-of-use and announced via an in-platform notification.

Article 8 — Governing Law, Jurisdiction, and Dispute Resolution

These Terms are governed by Turkish law. The parties agree that the İzmir (Central) Courts and Enforcement Offices shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms.
